Affiliates Policy

This page, along with the referenced documents, provides information about the legal terms and conditions (“Agreement”) governing our contract with you, the Affiliate, within our Affiliate Programme. It is essential to carefully read and understand this Agreement before agreeing to join us as an Affiliate. By agreeing to become one of our Affiliates, you are bound by the terms outlined in this Agreement and the accompanying documents.

Upon entering this Agreement, you confirm that you are either over 18 years old or of legal age to enter into contracts in your jurisdiction, whichever is applicable.

Failure to accept this Agreement means you will not be eligible to receive any commissions for referrals to our business.

We advise printing a copy of this Agreement for future reference.

Please note that we may revise this Agreement periodically, as specified in clause 4.2. The Affiliate Terms in effect at the time a referred individual places an order for Services with us will be applicable, as published on our affiliate site.

Parties

1.1

Hostingly Ltd a company incorporated in England and Wales under number 15435064 (“Hostingly”, “we”, “us”, “our”); and

You, the person, business or charitable organisation engaging with us as an affiliate (“Affiliate”, “you”, “your”), (each of Hostingly and the Affiliate being a “party” and together Hostingly and the Affiliate are the “parties”).

Background

2.1

Hostingly supplies the Services (as defined below).

Hostingly wishes to appoint the Affiliate as its non-exclusive agent in the Territory (as defined below) for the marketing of the Services on the terms of this Agreement.

The Affiliate has agreed to market the Services in the Territory on Hostingly’s behalf on the terms of this Agreement.

Affiliate Enrollment

3.1
  • Affiliate Enrollment: The Affiliate agrees to enroll in Hostingly’s Affiliate Program through the designated registration process.
  • Approval: Hostingly reserves the right to approve or reject any Affiliate application at its sole discretion.

Affiliate Responsibilities

4.1
  • Promotion: The Affiliate agrees to promote Hostingly’s products and services in compliance with applicable laws and regulations.
  • Marketing Materials: Hostingly will provide the Affiliate with marketing materials and tracking links necessary for promotion.
  • Compliance: The Affiliate agrees to comply with all terms and conditions outlined in this Agreement and any additional guidelines provided by Hostingly.

Commission Structure

5.1
  • Commission Rate: Hostingly will pay the Affiliate a commission for each eligible referral in accordance with the commission rate specified in the Affiliate Program guidelines.
  • Payment Terms: Commissions will be paid out on a monthly basis, subject to a minimum payment threshold and a designated payment method chosen by the Affiliate.

Termination

6.1
  • Termination: Either party may terminate this Agreement at any time, with or without cause, by providing written notice to the other party.
  • Effect of Termination: Upon termination of this Agreement, the Affiliate will immediately cease all promotional activities related to Hostingly and forfeit any unpaid commissions.

Confidentiality

7.1

Confidential Information: The Affiliate agrees to keep confidential all proprietary information provided by Hostingly, including but not limited to customer lists, pricing, and marketing strategies.
